The Annotated Powers of Attorney 2024 – Law Society of Ontario


On January 24 Alex Procope co-chaired the Law Society of Ontario’s annual Professional Development Program: The Annotated Powers of Attorney for Property and for Personal Care 2024 along with Alexandra Manthorpe of Cunningham, Swan, Carty, Little & Bonham LLP.

This program provided up-to-date annotated POA precedents and valueable commentary on many difficult issues. Speakers included: Alyssa Lane from Advocacy Centre for the Elderly, Hannah Lee from ARCH Disability Law Centre, Jennifer Corak, Andrew Felker, Brittany Miller, Amelia Yiu, Lucy Main and Tanisha Tulloch. Some of the most talked about topics this year included:

  • The obligations on lawyers to accommodate disability and not to charge higher fees for the accommodations.
  • The lack of clarity on the effectiveness of joint and several appointments and majority rules clauses for Health Care Consent Act, 1996 decisions.
  • Various issues around the appointment of non-residents and appointements of attorneys dealing with property in other jurisdictions.
